Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and sare-ai ("we," "us," or "our"). By creating an account, entering a beta access code, or otherwise using the sare-ai platform ("Service"), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to any part of these Terms, you must immediately cease using the Service and close your account. We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the Service after any changes constitutes your acceptance of the updated Terms. The "Last updated" date above reflects when these Terms were last revised.

You represent that you are at least 18 years of age, or 13 years of age with verifiable parental or guardian consent. The Service is not directed at, and may not be used by, children under 13.

sare-ai is currently operating as a closed beta. Access requires a valid invitation code ("Beta Code") distributed at our sole discretion. Beta Codes are personal, non-transferable, and may not be shared or sold.

During the beta period, the Service is provided on an experimental basis. Features, limits, pricing, and functionality may change at any time without notice. We make no guarantees regarding availability, uptime, or the continuation of beta access beyond any stated period.

Beta users acknowledge that the Service may contain bugs, experience outages, or produce unexpected results, and agree not to hold sare-ai liable for any losses or damages arising from such issues during the beta period.

To use the Service, you must register with a valid email address and complete our email verification process. You agree to provide accurate, current, and complete information and to keep your account information updated.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised access or security breach.

We reserve the right to require re-verification or additional authentication at any time. Accounts found to be created fraudulently, using temporary or disposable email addresses, or in violation of these Terms may be terminated without notice.

sare-ai is an AI-powered platform that generates vector graphics (SVG files) and other visual assets based on text prompts ("Prompts") submitted by users. The Service operates on a credit-based system where each generation consumes one or more credits from your account balance.

AI-generated outputs are produced using third-party AI infrastructure. We do not control or guarantee the accuracy, quality, appropriateness, or uniqueness of generated content. Generated content may inadvertently resemble existing works; it is your responsibility to conduct any necessary clearance or review before commercial use.

The Service includes additional features such as: a personal design library, batch generation (producing multiple variations from a single prompt), style reference transfer, negative prompt exclusions, a Brand Kit (storing your brand colours and typography preferences locally in your browser), prompt autocomplete, commercial licence certificate generation, and licence verification. All features are subject to change or removal at our discretion.

All designs you generate through sare-ai are granted a worldwide, royalty-free, perpetual commercial licence. Subject to these Terms, you own the output of your generations and may:

• Use designs in commercial projects, client work, and products
• Sell designs or products incorporating the designs
• Use designs without attribution to sare-ai
• Modify, adapt, and remix the designs

You may not: resell or sublicence access to the sare-ai platform itself; reverse-engineer, copy, or replicate our underlying technology or models; use generated content in a manner that infringes third-party intellectual property rights.

sare-ai retains all rights in its platform, software, branding, and documentation. Nothing in these Terms transfers any sare-ai intellectual property to you.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to generate, upload, or transmit content that:

• Is illegal or facilitates illegal activity in any jurisdiction
• Depicts, promotes, or glorifies violence, hatred, or discrimination
• Is sexually explicit, obscene, or pornographic
• Infringes the intellectual property, privacy, or publicity rights of any third party
• Constitutes spam, phishing, or deceptive practice
• Contains malware, viruses, or malicious code
• Is designed to circumvent, attack, or disrupt our systems, other users, or third-party services
• Impersonates any person, entity, or brand in a misleading way

We actively monitor usage patterns and reserve the right to review any account suspected of policy violations. Violations may result in immediate account suspension or permanent termination without refund or prior notice.

Credits are the unit of exchange for generating content on sare-ai. Free-tier credits are provided at our discretion and may be adjusted, reset, or revoked at any time without notice. Purchased credits are non-refundable once added to an account.

Subscription plans are billed on a monthly or annual cycle as selected at the time of purchase. By subscribing, you authorise recurring charges to your payment method. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and no prorated refunds are issued for the remaining period.

One-time credit top-ups are final and non-refundable. In exceptional circumstances (e.g., verified service failure on our part resulting in failed generations), we may issue credit adjustments at our sole discretion — this does not create an obligation for future refunds.

We reserve the right to change pricing, plan features, and credit costs at any time. Existing subscribers will receive at least 14 days' notice before any price increase takes effect.

To protect the integrity of the Service and our users, we automatically log certain security-relevant events including login attempts, account creation, and session activity. This logging records your IP address, browser/device user agent string, and the associated account email.

This data is used exclusively for fraud detection, abuse prevention, account security, and legal compliance. It is never used for advertising. See our Privacy Policy for full details on retention periods and your rights regarding this data.

You consent to this security logging as a condition of using the Service.

We strive to maintain high service availability but provide no uptime guarantee or SLA. The Service may be interrupted, suspended, or modified at any time for maintenance, security reasons, legal compliance, or any other reason, with or without notice.

We are not liable for any direct or indirect losses resulting from downtime, outages, maintenance windows, generation failures, data loss, or any other service interruption, regardless of cause.

We reserve the right to suspend, restrict, or permanently terminate any account at our sole discretion for any reason, including but not limited to: violation of these Terms, suspected fraud or abuse, legal obligations, or inactivity exceeding 24 months.

Upon termination, your right to access the Service immediately ceases. Remaining credits are forfeited unless termination was caused solely by our error. You may request export of your generated designs before termination where technically feasible.

You may delete your account at any time through account settings. Account deletion is irreversible. We will retain certain records as required by law or for legitimate security purposes even after account deletion; see our Privacy Policy for details.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) generated content will meet your requirements or be free from defects; (c) AI outputs will be accurate, unique, or free of third-party intellectual property; (d) the Service will be compatible with your devices or software.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SARE-AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• Your use of or inability to use the Service
• Any unauthorised access to or alteration of your data
• Any third-party content or conduct on the Service
• Any AI-generated content and its use or misuse
• Any bugs, errors, or inaccuracies in the Service

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law. In no event shall our aggregate liability exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or €50, whichever is greater.

You agree to defend, indemnify, and hold harmless sare-ai and its affiliates, officers, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your Prompts or generated content; (c) your violation of these Terms; (d) your violation of any third-party rights.

The Service relies on third-party infrastructure and API providers for cloud database storage, transactional email delivery, AI model inference, and web hosting. The specific identities of these sub-processors are available upon request via a support ticket.

Your use of sare-ai does not create a direct contractual relationship with any of our sub-processors. We are not responsible for the availability, accuracy, content, security practices, or conduct of any third-party services. The presence of third-party integrations within the Service does not constitute an endorsement of those providers.

In the event a third-party provider suffers an outage, data breach, or service degradation, sare-ai's liability is limited as set out in Section 12. We will make reasonable efforts to notify affected users of any material incidents involving their personal data.

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, including the Personal Data Protection Law No. 6698 (KVKK), without regard to conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the courts of Istanbul, Turkey, which shall have exclusive jurisdiction.

Notwithstanding the above, we reserve the right to seek injunctive or other equitable relief in any jurisdiction to protect our intellectual property or prevent irreparable harm.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and sare-ai regarding the Service and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

Assignment. You may not assign or transfer your rights or obligations under these Terms. We may assign our rights without restriction.

Force Majeure. We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, or third-party service failures.
